 Legal Background

The regulatory use of ratings in Ukraine is defined by a number of laws that provide for direct requirements to certain companies and bond issuers to obtain credit ratings from recognized local or international CRAs, and laws that provide for requirements to certain investors to use credit ratings when placing investments or calculating credit risks.

Requirements to be rated:

  • state owned joint stock companies have to disclose their credit rating in the annual report
  • bond issues for public sale have to be rated during its circulation term

Requirements to use ratings when investing:

  • insurance companies may invest their insurance reserves only in bank deposits and securities that have an investment grade credit rating by the national rating scale
  • non-state pension funds may invest their assets only in bank deposits and securities that have an investment grade credit rating by the national rating scale
  • banks make use of credit ratings when identifying credit quality of certain assets and calculating banking reserves (no ECAI status is needed, no mapping is established)

Credit rating agencies are supervised by the National Commission for Securities and Stock Market of Ukraine that has developed a procedure for recognition of CRAs as well as general regulations and guidelines for CRAs mainly based on principles of the IOSCO Code of Conduct for CRAs.
